In Florida a deed is required to transfer title and ownership of real estate. The deed must also be recorded with the Clerk of Court in the county where the property lies. Florida law mandates that deeds have certain requirements, otherwise the transfer of title is not accomplished. In our years of practice we have come across countless deeds that were prepared by non-attorneys that work in contravention to the intended transfer. We assist individuals and corporate entities in the preparation of deeds to accomplish transfers of real estate property.
We also assist and encourage our clients to use title transfers for estate planning purposes via enhanced life estate deeds or “lady bird” deeds. One could convey future title to the heirs by deed, while keeping control of the property during their lifetime. For example, spouses could convey their property to themselves for life with a remainder interest to their children or other heirs. The remaindermen (heirs) obtain title immediately upon the death of the life estate owner without probate court proceedings. In Florida, a lady bird deed is a legal form that transfers property upon death inexpensively and without probate. A lady bird deed allows the current property owner to use and control the property during the owner's lifetime, while the property automatically transfers upon death to designated beneficiaries.
In Florida, a landlord can evict a tenant for a variety of reasons, but the landlord must terminate the tenancy first. The landlord terminates the tenancy by giving the tenant written notice, as required by Florida law. Landlords must never take self-help measures, such as locking a tenant out or forcibly removing the tenant. Taking illegal self-help measures can have serious consequences. The only lawful way to remove a tenant from a rental property is to adhere to all pre-suit written notice requirements, file suit and then obtain an eviction order from a Court.
